Bard Davol, Inc. is the manufacturer of the Kugel hernia patch, first approved by the FDA in 1996. The device is made from two layers of polypropylene and intended mainly for use in laparoscopic hernia repairs. Due to its function in the laparoscopic procedure, the patch is intended to be folded before inserted to the repair site and has a memory recoil ring that helps to open the patch to its full size once it is in place. It is because of the memory recoil ring that Bard Davol began to face some serious consequences. The ring was at risk of malfunctioning within the body once deployed. This dangerous possibility could cause bowel perforations and intestinal fistulas that could even be fatal if not repaired in time.

The many adverse reports made about the Kugel mesh patch forced the FDA to issue a Class I recall of a number of Kugel patches from 2005 to 2007. A Class I recall is the most serious of the recalls the FDA might announce as it means that there is “a reasonable probability that the use of or exposure to a violative product will cause serious adverse health consequences or death.” The initial recall covered international clients in December 2005; patients in the United States were added days later.

The recall letters continued to be sent:  two in 2006 with another wave of recalls triggered in 2007. Despite these recalls, Bard Davol has continued to manufacture hernia mesh, including Sepramesh, 3DMax, and PerFix. A Class III recall was issued for some units of 3DMax mesh in 2008 because of mislabeling. A Class III recall is less serious than a Class I recall because its use is “not likely to cause adverse health consequences.”

Lawyers successfully combined the cases filed in a MDL in Rhode Island. Bard Davol eventually settled more than 2,000 suits in 2011 for $184 million dollars. These recalls, lawsuits and settlements serve as a cautionary tale for the rest of the industry now facing similar complaints related to complications suffered by many patients who have been implanted with surgical mesh during hernia repair. These complications are even calling into question the very use of mesh in repair, requiring doctors and patients to weigh the risks of recurrence versus the increase in serious complication risks.
