Atrium Medical, part of the Maquet Getinge Group is the manufacturer of C-QUR surgical mesh. The product was cleared by the FDA through their accelerated 510(k) process in 2006. Medical devices that go through this process are substantially similar to medical devices already on the market. Often this means that the products may not undergo as much testing and examination as new products that are not substantially similar. After the release of the original mesh product, numerous variations were subsequently released by Atrium from 2008 to 2015. All of those brands are still being sold and used today. C-QUR surgical mesh is made of polyethylene and is coated with fish oil. Polyethylene, when used in a medical device, has been known to shrink, cause inflammatory reaction, infections and erosion among other complications.

The omega-3 oil is intended to decrease or prevent inflammation and scarring as well as adhesions; however this has not been the case. In fact, there was a recall of nearly 150,000 units of this type of mesh because the coating was sticking even to the packaging and peeling off even before it was applied. It is not surprising, then, to hear that there have been many reports of C-QUR mesh attaching itself in a harmful way once implanted during hernia repair. In a particularly disturbing animal study of Atrium C-QUR mesh there were very high rates of infection and one of the animals died from complications caused by the mesh. A bowel obstruction occurred after mesh adhesions presented themselves.

Recently, in 2016, lawsuits have been filed against Atrium Medical for its C-QUR hernia mesh. Plaintiffs have claimed a number of complications due to the hernia mesh. The suits allege that the manufacturer “negligently designed, manufacture, marketed, labeled, packaged and sold medical devices,” and that defective design and testing resulted in a high failure rate and extensive hernia mesh complications.” In one case, doctors found oozing adhesions when they performed surgery to address complications created by C-QUR mesh. In fact, they were forced to remove part of the patient’s stomach along with all of the mesh because the adhesions were so severe.

In December 2016, lawyers consolidated all suits against Atrium Medical concerning C-QUR mesh as an MDL in the District of New Hampshire because a significant number of cases were pending in the district and Atrium is headquartered in New Hampshire. More than 100 actions are part of the MDL. These suits are ongoing and Plaintiffs continue to join them.
