Multidistrict Litigation is a legal procedural tool used to standardize, streamline and centralize civil cases that are more complex than run of the mill lawsuits. For example, cases that stem from major disasters (such as plane or train accidents) or products’ liability situations resulting from defect that affect people all over the country rather than just in an isolated incident. The system was created by Congress in 1968 in response to an extraordinarily large number of electrical equipment antitrust cases that were overwhelming the federal judicial system.

The United States Panel on Multidistrict Litigation consists of seven federal judges from different federal districts who are appointed by the Chief Justice of the Supreme Court, the head of the federal judicial system. Situations where there are claims filed in numerous districts, all relating to same or similar circumstances are referred to the MDL Panel where the judges decide 1) whether all the actions should be transferred to one district for all pre-trial proceedings, and 2) where these proceedings should take place and before which judge. The reason for centralizing, or transferring, all cases to one court is to prevent duplication of work and to maintain consistency in pre-trial rulings. This can help save resources (financial and other) on both sides of the lawsuits as the expenses involved in class action, pre-trial proceedings can be costly under the best circumstances.

Hernia mesh is used in surgical procedure to repair the damaged tissue and weakened muscle walls in cases of hernia injury. Sadly, there have been many instances where use of hernia mesh has caused complications that seriously medically compromised patients. These medical complications have led to serious consequences for many, including revision surgery, bowel perforation or obstruction, adhesions, fistulas, device migration, autoimmune reaction, infections, or reoccurrence of injury. Lawsuits have suggested that hernia mesh manufacturers did not sufficiently test products before bringing them to market, negligence, and other allegations.

In 2007, a multimillion-dollar lawsuit was filed against Bard Davol, the manufacturer of the Kugel Patch for complications related to hernia mesh. Lawyers successfully combined the cases filed in a MDL in Rhode Island. Bard Davol eventually settled more than 2,000 suits in 2011 for $184 million dollars. Recently, in 2016, lawsuits have been filed against Atrium Medical for its C-Qur hernia mesh and Ethicon (a Johnson & Johnson company) for its Physiomesh. In December 2016, lawyers consolidated all suits against Atrium Medical concerning C-Qur mesh as an MDL in the District of New Hampshire. In June 2017, an MDL was established for the cases against Ethicon in the Northern District of Georgia. These suits are ongoing and Plaintiffs continue to join them.
